Welcome to Reflektive (“the App”), operated by Myndful Innovations LLC (“we,” “us,” or “our”). By accessing or using Reflektive, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.
Nature of Service and Purpose
1.1 Entertainment and Informational Purposes Only
Reflektive is a technology platform designed for informational, educational, self-reflection, and entertainment purposes only. The App uses artificial intelligence to facilitate guided self-reflection, thought organization, and personal insight generation.
1.2 Not a Medical or Therapeutic Service
Reflektive IS NOT AND DOES NOT PROVIDE:
- Medical advice, diagnosis, or treatment of any kind
- Therapy, psychotherapy, counseling, or any form of clinical mental health treatment
- Psychiatric or psychological services
- Crisis intervention or emergency mental health services
- A substitute for professional medical, psychological, or psychiatric care
- A medical device or FDA-regulated product
- Services of a licensed healthcare provider
1.3 Professional Care Disclaimer
The content, responses, and features provided by Reflektive — including but not limited to AI-generated responses, Alignment Scores, Pattern Recognition insights, Memory Graph data, and any other output — are generated by artificial intelligence algorithms and are not reviewed, verified, or approved by licensed healthcare professionals. These outputs should never be used as the basis for medical or clinical decisions.
Eligibility
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not use the App under any circumstances.
Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account.
Subscriptions, Billing, and Cancellation
4.1 Free and Paid Tiers
Reflektive offers both free and paid subscription tiers. Features available under each tier are described on our website and within the App and may change at any time at our sole discretion.
4.2 Billing
Paid subscriptions are billed on a recurring monthly basis through the platform from which you subscribed (Apple App Store, Google Play Store, or our website). By subscribing, you authorize recurring charges to your selected payment method.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through your App Store account settings, Google Play account settings, or by contacting us. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods unless required by applicable law or the policies of the platform through which you subscribed.
4.4 Price Changes
We reserve the right to change subscription pricing at any time. Price changes will not affect your current billing period and will be communicated with at least 30 days' notice.
Artificial Intelligence Disclaimer
5.1 AI-Generated Content
Reflektive uses artificial intelligence, including third-party large language models, to generate responses, insights, scores, and other content. All AI-generated content is provided “as is” and may contain errors, inaccuracies, or inappropriate content. AI outputs do not represent the opinions, advice, or recommendations of Myndful Innovations LLC or any human professional.
5.2 No Guarantee of Accuracy
We do not guarantee the accuracy, completeness, reliability, suitability, or availability of any AI-generated content. You acknowledge that AI systems can produce incorrect, misleading, or biased outputs, and you agree to use all content at your own risk and discretion.
5.3 No Reliance
You agree not to rely on any information or content provided by Reflektive for making important life decisions, including but not limited to medical, financial, legal, career, or relationship decisions, without first consulting with qualified professionals in the relevant field.
User Content and Data
6.1 Your Content
You retain ownership of any text, voice recordings, or other content you submit to the App (“User Content”). By using the App, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing and improving the App's services to you.
6.2 Prohibited Uses
You agree not to use the App to:
- Violate any applicable law, regulation, or third-party rights
- Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to reverse-engineer, decompile, or disassemble the App or its underlying technology
- Use the App to develop competing products or services
- Interfere with or disrupt the App's infrastructure or other users' experience
- Use automated systems (bots, scrapers) to access the App without our written consent
- Attempt to bypass any usage limits, rate limits, or access controls
Intellectual Property
All rights, title, and interest in and to Reflektive — including but not limited to the software, design, branding, logos, trademarks, AI models, algorithms, content, and documentation — are and shall remain the exclusive property of Myndful Innovations LLC. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Indemnification
You agree to indemnify, defend, and hold harmless Myndful Innovations LLC, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or inability to use the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the App.
Assumption of Risk
By using Reflektive, you acknowledge and agree that:
- (a) the App is for entertainment, informational, and educational purposes only
- (b) AI-generated content may be inaccurate, incomplete, or inappropriate
- (c) you are solely responsible for any actions you take or decisions you make based on the App's output
- (d) the App is not a substitute for professional advice of any kind
- (e) you use the App entirely at your own risk
Dispute Resolution and Arbitration
11.1 Binding Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall take place in Pinellas County, Florida, or at another location agreed upon by both parties. The arbitrator's decision shall be final and binding.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of laws principles.
Termination
We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including but not limited to Limitation of Liability, Indemnification, Dispute Resolution, and Intellectual Property) shall survive.
Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must stop using the App.
Third-Party Services
Reflektive integrates with third-party services including AI model providers, voice processing services, and cloud infrastructure providers. We are not responsible for the practices, policies, or content of any third-party services. Your use of third-party services is subject to their respective terms and policies.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements, understandings, and communications.
